HIGH Hon'ble High Court of Jammu & Kashmir and Ladakh in SWP No. 2135/2009, Pronounced on: 26.05.2023 in the case of Ashok Kumar Sharma Vs Union of India has held that all entries in the Annual Confidential Reports (ACR) of an employee, including adverse entries, should be communicated to him with a reasonable opportunity to make a representation against it.
Non-communication of such an entry may adversely affect the employee in two ways:-
(1) if the entry is communicated to him, he would know about the assessment of his work and conduct by his superiors, which would enable him to improve his work in future;
(2) he would have an opportunity of making a representation against the entry if he feels it is unjustified, and can pray for its upgradation.
