Service Matters-Departmental inquiries after retirement

Hon'ble SUPREME COURT OF INDIA Before:- Ajay Rastogi and Bela M. Trivedi, JJ. in Writ Petition (Civil) No. 1042 of 2021. D/d. 17.05.2023.in case of Suchismita Misra vs High Court of Orissa & Ors. - . has held that "Departmental inquiries can indeed be initiated against retired officers/employees with the sanction of government but must be within four years from the date of such institution."

“7. Right of Government to Withhold or Withdraw Pension-

(1) XXXX

(2) (a) XXXX

(b) Such departmental proceedings as referred to in sub-rule(1) if not instituted while the Government servant was in service, whether before his retirement or during his reemployment 

(i) shall not be instituted save with the sanction of Government;

(ii) shall not be in respect of any event which took place more than four years before such institution
